TERMS AND POLICIES FOR PRIVATE CLASSES/PROCTORING

All sales are subject to a 3.9 % technology fee. You can avoid this fee by paying cash or by business check at least 2 weeks prior to scheduled class and/or exam.

Client acknowledges that the content of course material based on the latest FDA Food Safety Code is designed as a “one size fits all” when being applied to different types of food service operations. The age range, geographical origination of examinees, educational background including reading comprehension, etc. are significant obstacles in many examinees ability to pass the required exam. It is important your staff properly prepare themselves for the class and exam by spending the appropriate amount of time reading the course manual, power point, videos and flashcards before attending the class. You should encourage them to take the included practice exams so they may gauge their understanding of the material. (A minimum of 4 hours is suggested).

Refund/Cancellation Policy: There are no refunds allowed. Re-scheduling of class date is allowed based on instructor’s availability. A $150.00 rescheduling fee will be charged. If Food and Alcohol Safety Classes has to postpone a class due to inclement weather or force majeure, a mutually alternative date shall be decided upon with no penalties involved. No refunds are allowed for postponements due to force majeure or weather. FnaSafety, Integrated Food Service Consulting, Co (IFSC), our affiliate instructors and/or proctors are not responsible should the class and/or exam be interrupted or cancelled due to the testing company’s website failure and/or problems, or with wifi availability, problems with electronic devices being used for class and/or exam. Furthermore client understands that FnaSafety, IFSC, and affiliates will not be held responsible for any monetary and or time compensation. All customer grievances regarding this must be brought to the attention of the testing company; ServSafe or NRFSP. Client agrees to conform to any and all rules, regulations, and standards pertaining to conducting a class by the exam parent company and furthermore agrees to be bound by all examination standards dictated in writing or oral presentation from the instructor/proctor regarding the conducting and administering of an exam. Any and all expenses incurred from having to meet these outlined points shall be the responsibility of the client and the client holds the instructor/proctor harmless from any monetary liability that shall be incurred by the client.  Information presented during training is local, state, and federal regulatory accepted food safety information. Instructors may use real world examples during class instruction; however, at no time is the example to be construed as direct action for a specific business or situation.

Client agrees that the Physical Exam Facility meets the following minimum requirements:

  • Permits all Examines to perform to their highest level of ability.
  • Adheres to fire, safety, building (including codes regarding smoking), and occupancy in the local jurisdiction.
  • Meets all state and/or local regulatory requirements for exam administration.
  • Offers adequate lighting, heating, cooling, ventilation, writing surfaces, and seating.
  • Acoustics allow examines to hear instructions.
  • Allows efficient spacing between each examine in actual testing area, or appropriate and effective methods to prevent any examine from viewing another’s responses.
  • Offers ability to monitor the examines and the computer monitors at all times.
  • Accessible for examines with disabilities (e.g., wheelchair  accessibility).
  • Location is private to Proctor and Examine’s only during Exam administration.
  • Client is responsible to supply at their expense audio visual equipment and classroom supplies as requested by the instructor or our office.
  • Occasionally we have individuals looking for a one day class who are located near you. If we place them in your session you will be compensated $50.00 for each one. If you do not want to participate in this please send an email to our office indicating so.
  • Re-testing for those who took our class and failed the exam can be arranged directly with us for $149.00. Not available in all areas and FnaSafety is not responsible for retesting or for rescheduling for those who missed the schedule class and/or exam.

PAYMENT OF OUR INVOICE (TO FOLLOW) WHEN PAID WILL BE DEEMED AS ACCEPTANCE OF THE ABOVE TERMS, CONDITIONS AND POLICIES IN LIEU OF A SIGNED AFFIDAVIT OR DOCUMENT BY THE ABOVE CONTRACTING BUSINESS AND/OR ITS CONTACT PERSON(S). ANY AND ALL DISPUTES WILL BE CONTESTED EXCLUSIVELY IN THE STATE OF NEW YORK, THE COUNTY OF WESTCHESTER.
